Please read these Terms carefully before placing an Order.

By placing an Order, you confirm that you have had the opportunity to read and understand these Terms.

PART A – GENERAL CONTRACT TERMS

1. BUSINESS-TO-BUSINESS BASIS

1.1 KBH Training Academy provides professional vocational training, equipment and related products primarily for professional and business use within the beauty, aesthetics, hair and wellness industries.

1.2 Where you purchase as a business customer, you confirm that your purchase is being made wholly or mainly for purposes relating to your trade, business, craft or profession.

1.3 Where requested at checkout, you must provide your business or trading name together with accurate purchaser information.

1.4 If you purchase on behalf of a company, partnership, salon, clinic or other organisation, you confirm that you have authority to enter into the Contract on its behalf.

1.5 References within these Terms to B2B transactions apply where the purchaser is acting wholly or mainly for business or professional purposes.

1.6 Nothing in these Terms excludes or restricts any statutory right, remedy, liability or obligation which cannot lawfully be excluded or restricted.

1.7 Where an individual legally qualifies as a consumer despite the professional nature of the Goods or Services purchased, applicable mandatory consumer rights remain unaffected.

2. DEFINITIONS

For these Terms:

3. ORDERS AND CONTRACT FORMATION

3.1 You are responsible for checking the details of your Order before submitting it.

3.2 You must provide accurate and complete information when placing an Order.

3.3 Submission of an Order does not automatically mean that KBH has accepted it.

3.4 An Order will normally be accepted when we:

  • issue confirmation of acceptance;

  • provide access to purchased digital content;

  • commence providing the purchased Service; or

  • dispatch the Goods,

as applicable.

3.5 We may refuse or cancel an Order before acceptance where there is a legitimate reason, including:

  • incorrect pricing;

  • obvious website error;

  • stock unavailability;

  • inability to obtain a special-order item;

  • failure to satisfy Course prerequisites;

  • suspected fraud;

  • payment failure; or

  • circumstances making supply unlawful or unsafe.

3.6 Where payment has already been taken for an Order which KBH cannot accept, the applicable amount will be refunded.

4. PRODUCT AND COURSE INFORMATION

4.1 We take reasonable care to describe Courses, Goods and Services accurately.

4.2 Photographs and illustrations are provided for identification and presentation purposes.

4.3 Minor differences in packaging, colour, finish or other non-material characteristics may occur where they do not materially change the nature or function of the item purchased.

4.4 Buyers should read the applicable Course or product description before purchasing.

4.5 Where a specific product specification, Course format, prerequisite, inclusion or exclusion is material to your purchase, you should confirm it before ordering if it is not clearly stated.

4.6 Nothing in these Terms permits KBH to substitute materially different Goods or Services without appropriate agreement or legal justification.

PART B – PRICES AND PAYMENT

5. PRICES

5.1 The price payable is the price displayed on our website or otherwise quoted and accepted when the Order is placed.

5.2 KBH Training Academy is not currently VAT registered. VAT is therefore not charged on our sales and KBH does not issue VAT invoices.

5.3 Delivery charges and any other applicable charges will be shown or communicated before completion of the Order where applicable.

5.4 Prices may be changed at any time for future Orders.

5.5 A subsequent price reduction, promotion or special offer does not create an entitlement to a retrospective refund or price adjustment for an Order already completed.

6. PAYMENT

6.1 Payment must be made using an available payment method or in accordance with an agreed invoice.

6.2 Unless otherwise expressly agreed, payment is required before Goods are dispatched or Services/course access are supplied.

6.3 KBH may withhold Goods, Services, Course access or certification while an amount properly due remains unpaid.

6.4 Where applicable to a qualifying commercial debt, KBH reserves its statutory rights concerning late-payment interest and reasonable debt-recovery costs.

7. DISCOUNT CODES AND PROMOTIONS

7.1 Discount codes and promotional offers are subject to any specific conditions stated with the promotion.

7.2 Unless expressly stated otherwise, promotional codes:

  • cannot be exchanged for cash;

  • cannot normally be combined with another promotion;

  • must be used before their expiry date; and

  • cannot normally be applied retrospectively to an existing Order.

7.3 KBH may withdraw or correct a promotion where it has been published in error, subject to any Contract already validly concluded.

8. PAYMENT PLANS AND THIRD-PARTY FINANCE

8.1 Where a third-party payment or finance provider is used, that provider may apply separate terms.

8.2 Approval of finance or instalment facilities is controlled by the relevant provider where applicable.

8.3 A dispute with a finance or payment provider does not automatically cancel the underlying Contract with KBH.

8.4 Nothing in this section restricts any statutory rights the Buyer may have against KBH or a finance provider.

PART C – TRAINING

9. PROFESSIONAL TRAINING

9.1 KBH Courses are designed for professional education within the beauty, aesthetics, hair and wellness sectors.

9.2 Course formats may include:

  • online theory;

  • theory-only training;

  • online practical assessment;

  • in-person practical training;

  • live virtual practical training;

  • examinations;

  • coursework;

  • case studies;

  • photographic evidence;

  • video evidence; and

  • supervised practical assessment.

9.3 The specific requirements of each Course are determined by the applicable Course description and assessment requirements.

10. COURSE PREREQUISITES

10.1 Some Courses require previous qualifications, Anatomy & Physiology or other professional experience.

10.2 Where prerequisites apply, the Student is responsible for ensuring they satisfy them.

10.3 KBH may request evidence of qualifications before practical training, assessment or certification.

10.4 Failure to satisfy a clearly stated prerequisite may prevent the Student from completing the Course.

11. INSURANCE, LICENSING AND PROFESSIONAL REQUIREMENTS

11.1 Students are responsible for determining whether a Course is suitable for their intended professional activities.

11.2 Students must independently check requirements imposed by their:

  • insurer;

  • local authority;

  • licensing authority;

  • employer;

  • professional body;

  • landlord or premises provider; and

  • any other relevant organisation.

11.3 KBH does not guarantee that every insurer will accept every Course, certificate, treatment or equipment type.

11.4 CPD accreditation does not constitute a guarantee of insurance acceptance.

11.5 Completion of a Course does not override any separate legal, licensing, insurance or professional requirement.

12. ONLINE COURSE ACCESS

12.1 Unless expressly stated otherwise on the applicable Course page, online access is provided for 12 weeks from the date access is granted.

12.2 Students are responsible for completing their Course within the applicable access period.

12.3 Depending upon the Course, access may include:

  • manuals;

  • theory;

  • examinations;

  • training videos;

  • demonstrations;

  • assessments;

  • case studies; and

  • practical evidence requirements.

12.4 Course access expires at the end of the stated access period.

12.5 Expiry of access does not mean that a Course has been cancelled and does not create an entitlement to a refund.

12.6 Where extensions are available, they may be purchased at the price applicable at the time the extension is requested.

12.7 Extensions are not automatically included in the original Course fee.

13. DIGITAL ACCESS AND ACCOUNT SECURITY

13.1 Digital Course access is personal to the enrolled Student.

13.2 Access details must not be transferred, sold, shared or provided to another person.

13.3 KBH may suspend access where there is reasonable evidence of account sharing, unauthorised copying, fraud or serious misuse.

13.4 Technical interruptions may occasionally occur because of maintenance, hosting, internet or third-party platform issues.

13.5 KBH will take reasonable steps to restore access where an issue is within our control.

14. THEORY-ONLY COURSES

14.1 Courses specifically described as Theory Only provide theoretical education only.

14.2 Theory-only Courses do not include supervised practical training or practical competency assessment unless expressly stated otherwise.

14.3 A theory-only certificate confirms successful completion of the applicable theoretical Course requirements.

14.4 It does not confirm that KBH has assessed the Student's practical competency.

14.5 Students are responsible for confirming whether theory-only education is acceptable to their insurer or other relevant professional organisation.

15. COURSEWORK AND ASSESSMENTS

15.1 Students must complete the assessments specified for their Course.

15.2 Submission of coursework does not automatically constitute a pass.

15.3 KBH may request:

  • corrections;

  • resubmissions;

  • clearer evidence;

  • additional evidence; or

  • further practical assessment

where the required standard has not been demonstrated.

15.4 Coursework and practical evidence must be the Student's own work.

15.5 Falsification of practical evidence, case studies, qualifications or assessment material may result in assessment being rejected and certification being withheld.

15.6 Students must submit coursework within applicable deadlines and before expiry of Course access unless otherwise agreed.

15.7 Any marking or response timeframe communicated by KBH is an operational target unless expressly stated to form part of the Contract.

16. PRACTICAL EVIDENCE AND CASE STUDIES

16.1 Where remote practical evidence is required, the Student is responsible for ensuring that the treatment was performed appropriately and that any required model/client consent has been obtained.

16.2 Students must not submit unnecessary confidential client information.

16.3 Photographs and videos submitted for assessment must be appropriate for educational assessment and supplied with any required permission.

16.4 Practical evidence must accurately represent the Student's own treatment work.

17. PRACTICAL TRAINING

17.1 Where practical competency assessment forms part of a Course, the Student must satisfactorily complete the required practical elements before the relevant certificate is issued.

17.2 Students must follow trainer instructions, infection-control procedures, treatment protocols and health and safety requirements.

17.3 KBH may stop or refuse a practical treatment where continuing would create an unacceptable safety risk.

17.4 Failure to demonstrate competency may result in additional evidence or further assessment being required.

18. LIVE VIRTUAL PRACTICAL TRAINING

18.1 Students undertaking live virtual training are responsible for providing:

  • appropriate equipment;

  • required products;

  • required consumables;

  • a suitable model where required;

  • a suitable and safe treatment environment;

  • reliable internet access; and

  • a suitable camera/device.

18.2 Any required theory must be completed before the practical session.

18.3 If the session cannot reasonably proceed because the Student is not appropriately prepared, rescheduling may be required and the applicable rescheduling fee may apply.

19. IN-PERSON TRAINING

19.1 Students must attend on the confirmed date, at the confirmed time and location.

19.2 Required theory and coursework must be completed by any deadline provided.

19.3 Failure to complete prerequisite work may result in the practical session being rescheduled.

19.4 Students must behave professionally and comply with reasonable health and safety instructions.

20. LATE ARRIVAL

20.1 Students should arrive in sufficient time for their scheduled training.

20.2 Where a Student arrives more than 10 minutes late, KBH may be unable to proceed where insufficient time remains to complete training safely and properly.

20.3 Where training must be rescheduled because of late arrival, a £50 rescheduling fee will apply.

21. RESCHEDULING

21.1 One reschedule may be permitted without charge where at least 7 days' notice is provided.

21.2 Where less than 7 days' notice is provided, a £50 rescheduling fee will apply.

21.3 Failure to attend without prior notice may result in the booked practical session being forfeited and a further fee being payable to arrange another session.

21.4 Repeated rescheduling may be refused where reasonable.

21.5 Any discretionary exception made by KBH does not create an entitlement to the same exception in the future.

22. ILLNESS AND EXCEPTIONAL CIRCUMSTANCES

22.1 Students should contact KBH as soon as reasonably possible where serious illness or exceptional circumstances affect attendance or Course completion.

22.2 KBH may request reasonable supporting evidence where a Student requests an exception to the normal rescheduling or access policy.

22.3 Any extension, fee waiver or alternative arrangement offered in exceptional circumstances is discretionary unless otherwise required by law.

23. MODELS

23.1 Where a model is required, the Student is responsible for arranging a suitable model unless KBH agrees otherwise.

23.2 The model must satisfy applicable treatment suitability and contraindication requirements.

23.3 KBH may refuse treatment where a model is unsuitable or treatment would present an unacceptable safety risk.

23.4 Where KBH agrees to arrange a model, a model fee may apply and will be confirmed before the session.

23.5 Availability of a KBH-arranged model cannot be guaranteed unless specifically confirmed.

24. STUDENT CONDUCT

24.1 Students must behave professionally toward trainers, staff, models and other Students.

24.2 Students must actively participate in practical training.

24.3 Unnecessary mobile-phone use during practical training may be restricted.

24.4 Threatening, abusive, discriminatory, intimidating or unsafe behaviour will not be tolerated.

24.5 KBH may stop training or require a Student to leave where serious misconduct or a genuine safety concern arises.

24.6 Nothing in this clause prevents a Student from making a legitimate complaint, raising a genuine concern, leaving an honest review or exercising a legal right.

25. CERTIFICATES

25.1 Certificates are issued only after the applicable Course requirements have been satisfactorily completed.

25.2 Certificates reflect the Course and assessment actually completed.

25.3 Theory-only certification does not represent practical competency assessment.

25.4 Students are responsible for ensuring that their name and other information supplied to KBH is accurate.

25.5 Where a certificate must be reissued because the Student supplied incorrect information, an administration fee may apply where disclosed before reissue.

25.6 A certificate does not constitute a guarantee of insurance, licensing, employment or business approval.

26. COURSE CANCELLATIONS AND REFUNDS

26.1 For B2B purchases, Course purchases are firm once digital access has been supplied, digital materials have been accessed or the Service has commenced.

26.2 Failure to complete a Course within the applicable access period does not create an entitlement to a refund.

26.3 Failure to obtain insurance, licensing approval or other third-party acceptance after purchase does not create an entitlement to a refund where the Course has been supplied as described.

26.4 Where KBH cancels a training session, we may offer an appropriate alternative date.

26.5 Where KBH cancels training and cannot provide a suitable alternative, the applicable amount paid for the cancelled Service will be refunded.

26.6 Nothing in this section excludes statutory rights or remedies which cannot lawfully be excluded.

26.7 Where a purchaser legally qualifies as a consumer, applicable statutory rights concerning services and digital content remain unaffected.

27. CHANGES TO COURSE CONTENT

27.1 KBH may update Course materials, protocols, recommended products, demonstrations or educational content to reflect developments in professional practice, equipment or safety guidance.

27.2 Such updates will not materially reduce a Service already purchased without appropriate justification.

PART D – INTELLECTUAL PROPERTY

28. COURSE MATERIALS

28.1 Course manuals, training videos, photographs, diagrams, graphics, assessments, protocols and other original educational materials remain the intellectual property of KBH or the applicable rights holder.

28.2 Course access provides the enrolled Student with a personal, non-transferable right to use the material for their own learning and professional reference.

28.3 Materials must not, without written permission, be:

  • copied for redistribution;

  • sold;

  • shared;

  • uploaded publicly;

  • republished;

  • distributed;

  • supplied to another training provider;

  • used to create or deliver another training Course; or

  • commercially exploited.

28.4 Students must not share account login information.

28.5 Unauthorised use may result in access being withdrawn and KBH reserving any legal remedies available to it.

29. RECORDING TRAINING

29.1 Students must not audio-record, video-record or livestream training sessions without prior permission.

29.2 Permission to make a recording does not automatically grant permission to publish, redistribute or commercially use that recording.

PART E – GOODS, MACHINES AND EQUIPMENT

30. EQUIPMENT AND PRODUCT ORDERS

30.1 Professional equipment may be ordered specifically for the Buyer.

30.2 Certain Goods may be special-order, supplier-order or otherwise obtained specifically to fulfil an Order.

30.3 Once a bespoke or special-order item has been ordered from the supplier, cancellation may not be possible for a B2B Order.

30.4 Where KBH agrees to cancellation, reasonable costs already incurred may be deducted where legally permitted.

31. DELIVERY

31.1 Delivery dates and timeframes are estimates unless expressly confirmed as guaranteed.

31.2 KBH will take reasonable steps to dispatch Goods within the applicable timeframe.

31.3 KBH is not responsible for delays resulting from circumstances outside its reasonable control.

31.4 The Buyer is responsible for providing an accurate and accessible delivery address.

31.5 Risk in Goods passes upon delivery to the agreed delivery address, subject to any mandatory rule of law which applies.

32. INTERNATIONAL ORDERS

32.1 International Buyers are responsible for checking whether Goods can lawfully be imported, possessed and professionally used in their destination country.

32.2 Unless expressly stated otherwise, customs duties, import taxes, customs-clearance fees and other destination charges are the responsibility of the Buyer.

32.3 KBH cannot control or guarantee charges imposed by customs authorities or other third parties.

32.4 Where Goods are returned because the Buyer refuses or fails to pay applicable import charges or complete required customs procedures, reasonable costs incurred may be deducted from any amount otherwise refundable where legally permitted.

33. OWNERSHIP OF GOODS

33.1 Ownership of Goods remains with KBH until full payment has been received.

33.2 Until ownership passes, the Buyer must take reasonable care of the Goods and must not deliberately remove identifying labels or serial numbers.

34. INSPECTION ON DELIVERY

34.1 Buyers should inspect Goods promptly following delivery.

34.2 Visible transit damage, shortages or incorrect Goods should be reported as soon as reasonably possible, preferably within 48 hours.

34.3 Photographic evidence may be requested.

34.4 Packaging should be retained where transit damage is suspected because the courier may require it.

34.5 A fault which was not apparent at delivery should be reported promptly after discovery.

34.6 The preferred 48-hour notification period assists with courier claims and does not remove any legal right or remedy which cannot lawfully be excluded.

35. B2B CHANGE-OF-MIND RETURNS

35.1 KBH does not automatically provide change-of-mind returns for Goods purchased on a B2B basis.

35.2 Any discretionary return must be authorised before Goods are returned.

35.3 Where a return is agreed:

  • Goods must be unused;

  • Goods must be in a condition suitable for resale;

  • original packaging should be retained where reasonably possible;

  • the Buyer is responsible for appropriate return carriage; and

  • any agreed reasonable restocking or administration charge will be communicated before acceptance.

35.4 Used, installed, activated or personalised Goods will not normally be accepted as a discretionary change-of-mind return.

35.5 This section does not apply to a valid claim involving faulty, misdescribed or incorrectly supplied Goods.

36. FAULTY GOODS

36.1 Where Goods appear faulty, the Buyer should cease using them where continued use could create a safety risk and contact KBH promptly.

36.2 KBH may reasonably request:

  • photographs;

  • video evidence;

  • fault descriptions;

  • serial numbers;

  • model information;

  • installation information;

  • maintenance information; and/or

  • return of the Goods for inspection.

36.3 Goods should not be dismantled, altered or subjected to unauthorised repair before assessment where this could prevent proper diagnosis of the issue.

36.4 The appropriate remedy will depend on the nature and cause of the fault, applicable warranty terms and legal rights.

37. EQUIPMENT WARRANTY

37.1 Unless a different warranty is expressly stated for a particular product, machines and electrical equipment supplied by KBH carry a 30-day KBH warranty from delivery.

37.2 Where expressly stated for a particular product, additional parts support may be available following the initial warranty period.

37.3 Additional parts support is not an extension of the full 30-day warranty unless expressly stated otherwise.

37.4 Warranty does not cover faults or damage caused by:

  • misuse;

  • accidental damage;

  • neglect;

  • incorrect installation;

  • unsuitable electrical supply;

  • failure to follow supplied instructions;

  • inadequate cleaning or maintenance;

  • unauthorised alteration;

  • unauthorised repair;

  • incompatible accessories or consumables;

  • physical damage occurring after delivery; or

  • other damage which did not arise from an inherent fault covered by the warranty.

37.5 Where assessment establishes that an issue is outside warranty, reasonable inspection, labour, parts and carriage costs may be payable.

37.6 Chargeable repair work will not be undertaken without applicable charges being communicated to the Buyer.

37.7 Unless expressly agreed otherwise, KBH does not provide a loan-machine service.

37.8 KBH does not guarantee uninterrupted business operation while equipment is being inspected or repaired.

37.9 Nothing in this warranty excludes a liability or remedy which cannot lawfully be excluded.

38. RETURN OF EQUIPMENT FOR ASSESSMENT

38.1 Where equipment is returned for inspection or repair, it must be packaged appropriately for transportation.

38.2 The Buyer should use suitable protective packaging and an appropriate delivery service.

38.3 KBH is not responsible for additional damage caused by inadequate return packaging.

38.4 Repair and assessment times depend upon the nature of the fault, technical requirements and availability of replacement parts.

39. REPLACEMENT PARTS AND CONSUMABLES

39.1 Availability and prices of replacement parts, cartridges, accessories and consumables may change.

39.2 Unless expressly guaranteed in writing, KBH cannot guarantee indefinite availability of replacement parts or consumables for discontinued equipment.

39.3 Buyers must use compatible parts and consumables appropriate for their equipment.

PART F – PRODUCT SAFETY AND COMPLIANCE

40. SAFE USE

40.1 Goods must be used only for their intended professional purpose and in accordance with applicable instructions and safety information.

40.2 Buyers are responsible for ensuring that operators are appropriately trained and competent to use professional equipment.

40.3 Equipment must not be used where it is damaged or where continued operation presents an apparent safety risk.

41. PRODUCT SAFETY INCIDENTS

41.1 If a product develops a potential safety issue, the Buyer should cease using it where continued use could present a risk and notify KBH promptly.

41.2 Buyers must reasonably cooperate with legitimate product-safety investigations, corrective actions or recalls.

41.3 KBH may contact Buyers where safety information, corrective action or recall information needs to be communicated.

41.4 Nothing in these Terms restricts obligations imposed by applicable product-safety legislation.

42. PRODUCT TRACEABILITY

42.1 Serial numbers, model identifiers and product labels must not deliberately be removed or altered.

42.2 Buyers should retain purchase information and relevant equipment documentation.

42.3 KBH may retain relevant supplier, model, serial and transaction information for product-safety, warranty and legal-compliance purposes.

43. CONFORMITY AND PRODUCT DOCUMENTATION

43.1 Applicable conformity assessment, marking, safety information, instructions and other regulatory documentation will be handled in accordance with the legislation applicable to the particular product.

43.2 The precise regulatory requirements may vary according to product type, intended purpose and the market into which it is supplied.

43.3 Nothing in these Terms represents that every product is subject to the same regulatory regime.

43.4 Buyers must not alter equipment in a way which may compromise its safety or regulatory conformity.

44. ELECTRICAL EQUIPMENT

44.1 Electrical equipment must be operated in accordance with the applicable specifications, instructions and safety information.

44.2 Buyers must ensure that the electrical supply at their premises is appropriate for the equipment.

44.3 Where professional electrical installation is required, installation must be performed by a suitably qualified and competent person.

44.4 The installer is responsible for determining appropriate circuit protection, electrical supply, isolation, earthing and other installation requirements applicable to the equipment and premises.

44.5 Where an electrical safety concern occurs, use must cease where continued operation could present a risk.

PART G – BUSINESS RESPONSIBILITIES

45. PROFESSIONAL USE OF EQUIPMENT

45.1 Purchasing equipment does not itself establish professional competency to perform a treatment.

45.2 The Buyer is responsible for ensuring that practitioners:

  • are appropriately trained;

  • operate within their competence;

  • have appropriate insurance;

  • comply with applicable local licensing requirements; and

  • comply with relevant health and safety requirements.

46. TREATMENT RESULTS

46.1 KBH does not guarantee a particular treatment result from equipment, products or training.

46.2 Results vary according to the practitioner, client, treatment parameters, equipment, products, aftercare and individual circumstances.

47. BUSINESS RESULTS

47.1 KBH does not guarantee:

  • earnings;

  • client numbers;

  • profitability;

  • employment;

  • business growth;

  • return on investment; or

  • commercial success

as a result of purchasing training or equipment.

PART H – COMPLAINTS, DISPUTES AND LIABILITY

48. COMPLAINTS

48.1 Concerns should be raised with KBH as soon as reasonably possible so they can be investigated.

48.2 Formal complaints should be sent to:

kbhtraining@outlook.com

48.3 Please include:

  • your name;

  • business name;

  • Order number where available;

  • Course or product involved;

  • details of the issue; and

  • relevant supporting evidence.

48.4 We aim to acknowledge formal complaints within 3 Business Days.

48.5 We aim to provide a substantive response within 14 Business Days, although complex technical or supplier investigations may require additional time.

49. CHARGEBACKS AND PAYMENT DISPUTES

49.1 Where you believe a payment or Order is incorrect, you are encouraged to contact KBH first so the matter can be investigated.

49.2 Nothing in these Terms prevents a Buyer from exercising a legitimate right available through their bank, card provider, finance provider or applicable law.

49.3 KBH reserves the right to challenge a chargeback or payment dispute which we reasonably believe is incorrect.

49.4 Evidence supplied in connection with a dispute may include:

  • Order information;

  • checkout records;

  • acceptance of these Terms;

  • business details supplied;

  • Course-access records;

  • access records where lawfully available;

  • assessment submissions;

  • attendance records;

  • correspondence;

  • dispatch records; and

  • proof of delivery.

50. LIMITATION OF LIABILITY

50.1 Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • another liability which cannot lawfully be excluded or restricted.

50.2 Subject to clause 50.1 and applicable law, KBH will not be responsible for indirect or consequential business loss which was not reasonably foreseeable when the Contract was entered into.

50.3 KBH is not responsible for loss resulting solely from the Buyer's failure to:

  • follow supplied instructions;

  • maintain equipment;

  • use suitable consumables;

  • obtain required training;

  • obtain appropriate insurance;

  • comply with professional requirements; or

  • comply with applicable regulatory or licensing requirements.

50.4 Nothing in these Terms excludes obligations that applicable product-safety law imposes upon KBH.

50.5 Any exclusion or limitation within these Terms applies only to the extent permitted by law.

PART I – DATA AND WEBSITE USE

51. DATA PROTECTION

51.1 Personal information is handled in accordance with KBH's Privacy Policy and applicable data-protection law.

51.2 KBH may retain relevant:

  • Order records;

  • training records;

  • assessment records;

  • certification records;

  • communications;

  • equipment information; and

  • complaint/warranty records

where reasonably required for educational, accreditation, insurance, administrative, product-safety or legal purposes.

52. WEBSITE AND MEMBERS' AREA

52.1 Access to the Members' Area is personal to the enrolled Student.

52.2 KBH may carry out reasonable maintenance, platform updates and security changes.

52.3 Temporary interruption of the website or Members' Area does not automatically create an entitlement to a refund.

52.4 Where a material interruption within KBH's control prevents access for a significant period, KBH will take reasonable steps to provide an appropriate remedy, such as restoring or extending access.

PART J – GENERAL LEGAL TERMS

53. EVENTS OUTSIDE OUR REASONABLE CONTROL

53.1 Neither party will be responsible for delay or failure caused by circumstances outside its reasonable control.

53.2 Such circumstances may include:

  • severe weather;

  • transport disruption;

  • utility failure;

  • supplier disruption;

  • industrial action;

  • government restrictions;

  • significant IT/platform failure;

  • public-health restrictions; or

  • other comparable circumstances.

53.3 Where training is affected, KBH will take reasonable steps to arrange an appropriate alternative.

54. CHANGES TO THESE TERMS

54.1 KBH may update these Terms from time to time.

54.2 The Terms applying to an Order will normally be those in force when the Order is placed.

54.3 Updating the website does not retrospectively impose a material adverse change upon an already accepted Order.

55. SUBCONTRACTORS AND THIRD PARTIES

55.1 KBH may use tutors, contractors, couriers, technicians, suppliers, fulfilment providers and other third parties to fulfil Orders.

55.2 This does not remove any responsibility which KBH cannot lawfully transfer or exclude.

56. INDEPENDENT SUPPLIERS AND REFERRALS

56.1 KBH may introduce or refer Students or customers to independent suppliers.

56.2 Where the customer contracts and pays the independent supplier directly, the resulting purchase is between the customer and that supplier.

56.3 The independent supplier is responsible for its own Goods, contractual terms, delivery, warranty, regulatory obligations and customer service.

56.4 KBH will disclose any referral or commercial relationship where disclosure is required by law.

56.5 This section does not apply where KBH itself is the seller of the Goods.

57. ENTIRE AGREEMENT – B2B TRANSACTIONS

57.1 For B2B transactions, the Contract consists of these Terms together with the accepted Order and any written quotation or specification expressly incorporated into the Contract.

57.2 Nothing in this clause excludes liability for fraud, fraudulent misrepresentation or another matter which cannot lawfully be excluded.

58. SEVERABILITY

58.1 If any provision of these Terms is found to be invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

58.2 The remaining provisions will continue to apply.
